Abstract
ENGLISH ABSTRACT: Usufruct is the oldest and most familiar personal servitude received into South African jurisprudence via Roman and Roman-Dutch law. In terms of usufruct the naked ownership of a property is granted to a certain person (the naked owner) while the competency to enjoy the use (usus) and fruits (fructus) of the property is conveyed to the usufructuary. The social function of usufruct is to provide the usufructuary with subsistence and simultaneously preserve important family assets within the family.
AFRIKAANSE OPSOMMING: Vruggebruik is die oudste en die bekendste persoonlike serwituut wat via die Romeinse en Romeins-Hollandse reg in die Suid-Afrikaanse reg geresipieer is. Ingevolge vruggebruik word eiendomsreg van 'n saak aan 'n bepaalde persoon (die blooteienaar) bemaak of geskenk, terwyl die bevoegdheid om die saak te gebruik (usus) en die vrugte van die saak te trek (fructus) aan die vruggebruiker oorgedra word. Die maatskaplike funksie van vruggebruik is om aan die vruggebruiker lewensonderhoud te verskaf en terselfdertyd belangrike familie-bates in 'n bepaalde familie te hou.
