As is the case in many other countries, public procurement law in South Africa has emerged from the
combined application of legal rules from many distinct fields of law to the phenomenon of state contracting.
Since no single comprehensive statute or code has been enacted to cover this field, public procurement
law in South Africa remains a hodge podge of rules from all the major branches of law. However, increased
focus on this area, including increased regulation, significant increases in litigation as well as increased
academic attention, has started to mould together the mixture of diverse legal rules into what is now
emerging as a distinct law of public procurement.
